Spouse/Partnership Visas

You can be eligible for a partner category visa, if you are either of the following:

  • The spouse of a citizen of Australia, Australian permanent resident or an eligible New Zealand citizen
  • The fiancé of a citizen of Australia, Australian permanent resident or an eligible New Zealand citizen
  • De Facto partner (including same-sex relationships) of a citizen of Australia, Australian permanent resident or an eligible New Zealand citizen
Which Visa Option is Right for You?

The following visa options fall under the category of partner visas and allow you to live temporarily or permanently in Australia if you are granted a visa.

Please note: Partner visa options vary depending on your circumstances, including if you are applying from inside or outside of Australia.

Applying in Australia

Option 1. Temporary Partner Visa (subclass 820) and Permanent Visa (subclass 801)

Use this option if you are applying for a visa in Australia and you are the spouse or de facto partner of a citizen of Australia, Australian permanent resident or an eligible New Zealand citizen.

Applying Outside Australia

Option 2. Partner (Provisional) Visa (subclass 309) and Permanent Visa (subclass 100)

Use this option if you are applying for a visa outside of Australia and are a spouse or de facto partner of a citizen of Australia, Australian permanent resident or an eligible New Zealand citizen OR you intend to marry before a decision is made on your Partner visa application.

Option 3. Prospective Marriage Visa (subclass 300)

Use this option if you are applying for a visa outside of Australia, intend to travel to Australia and marry a citizen of Australia, Australian permanent resident or an eligible New Zealand citizen after you have been granted the visa.
